Description | Competition law uses market shares to measure market power, especially for the assessment of a dominant position. Certain levels of market shares constitute related presumptions about an existence or an absence of a dominant position. Validity of such presumptions is not ideal from a theoretical perspective, because it disregards other relevant factors for the assessment of market power, and their efficiency is related to practical application by competition authorities. However, the Commission only applies the presumptions exceptionally. |
