Description | This paper gives a provisional and preliminary overview of results from the coding for the Flexible Implementation in the European Union (FIEU) dataset. These results are based on 85 coded directives that were adopted in the period 2006-2009. The FIEU dataset maps the occurrence of provisions granting discretion to member states in the implementation of EU law (so called ‘flexibility provisions’), and associated constraints on discretion. The paper outlines the background to and coding scheme for the dataset, and sketches some descriptive statistics drawn from the dataset so far. Based on these observations, a number of striking findings are identified, and an agenda for further analysis and study is outlined. |
