Description | The law and the legal system have been formed separately from the western world in today’s People’s Republic of China territory. Despite this fact, we can detect certain similarities when it comes to the question of the role of the law in a society and the relationship of law and morality. The aim of this article is to describe the Chinese legal philosophy, during the imperial times as well as after the birth of the republic in the early 20th century. The law and morality relationship will be emphasised – the widely discussed topic in the western legal philosophy; this will enable us to compare the Chinese and western approach. |
