Description | The article deals with the gratuitousness of the contract of mandate (mandatum) and examines whether remuneration for its fulfilment can be claimed despite its gratuitous nature. In Roman law, mandatum is formally always regarded gratuitous; however, it was usual to provide honorary payment (salarium) for its fulfilment. Later, this honorary payment becomes enforceable. Mandatum remains gratuitous in the Byzantine law, too, while salarium loses its technical meaning and is replaced by other expressions. |
