Description | The paper is devoted to the issue of short-term and long-term visas and their judicial review. Specifically, it deals with the issue of the existence of the right to judicial review of applicants for short-term or long-term visas, the scope for administrative discretion and the development of court decision-making practice in this area. The first part of the paper describes the nature and legal basis of short-term and long-term visas. The next part presents the development of legal regulation and case law of judicial exclusion and outlines how the Constitutional Court and the Supreme Administrative Court dealt with the issue of the existence of the right to judicial review of a visa decision in their case law. The key part of the paper deals with the breach of court exclusion, which occurred by the decision of the Supreme Administrative Court of 4. 1. 2018, file no. 6 Azs 253/2016 and the decision of the Regional Court in Prague of 23. 4. 2018, file no. 45 A 102/2016. |
