Description | In our conference contribution, we will focus on the rights of a juvenile arising from their position in criminal proceedings, which means the position of a witness, suspect or accused, especially in the context of the Criminal Procedure Code and the Act on Juvenile Justice. We will also take into account this view from the perspective of law enforcement authorities. Aspects of this issue will be analysed in the point of view of the comparative method. In accordance with de lege ferenda considerations, we conclude that the position of a juvenile during his interrogation is negatively affected by the fact that the current legislation allows that juveniles can be interrogated without their representative or the Organisation of social child protection. |
