Description | The book comprehensively elaborates on the proprietary and legal issues of the Czech state. It presents law regulations which contains, in addition to the constitutional framework, also significant private law regulations (especially the Civil Code), as well as important public law regulations – Act on State Property and its implementing decree, Act on Budgetary Rules of the Republic, Act on the Office for Government Representation in Property Affairs, Act on State Enterprise, as well as many other (related) regulations. After a brief historic introduction and description of the aforementioned constitutional framework, the publication focuses on ownership and other property rights of state including their performance; it defines assets of state, addresses his acquisition, management and handling as well as the responsibility when managing assets of state and control of adhering to obligations. The authors express their critical positions on the legal regulation as well as on the appropriate judicature and interconnect and confront the theory-based questions regarding the ownership and other property rights of the state with his proprietary and legal reality. |
