Description | The current decision-making practice of the Czech courts is increasingly specifying its requirements for proving the damage incurred and possible profit from criminal activity, i.e. unjustified enrichment of the offender at the expense of authors or persons entitled to intellectual property rights, thus noticeably relativizing the area of proving the criminal activity. The aim of this paper is to draw conclusions from the analysis of the most important court decisions in the field of enforcement of liability for unauthorised interference with intellectual property rights concerning the requirements for proving the extent of damage and unjust enrichment and the way of their determination by the Czech courts. |
