| Description | This article summarises the recent case law of the ECtHR in the field of environmental protection. It looks more closely at the application of the ne bis in idem principle in environmental protection, following the criteria clarified by the ECtHR in the 2016 A. and B. v. Norway judgement (24130/11, 29758/11). The case law of the Czech courts, both criminal and administrative, has gradually reflected the conclusions of the ECtHR in the tax cases. Recently, it has been moving into other areas, including environmental protection. The author therefore seems attempts to draw attention to this development. |
