Description The situation of national state during a pandemic is unprecedented in its modern history and basically unexpected, just as unexpected is therefore - in order to protect public health - the reaction of the state, or his executive power, issuing measures which significantly and authoritatively affect the legal sphere of individuals. Judicial power controlling this activity of the state, especially through administrative courts, but also the Constitutional Court, must then adequately deal with the specifics that arise from the above-mentioned exceptionality of the situation. The article pays particular attention to these specifics and to question, how they can be considered within the judiciary in the case of measures of abstract nature.
