| Description | Not only in Czechia, but also in many European countries, especially in recent years, there are significant changes in the field of family law. This is because the family is also changing. In some jurisdictions, there are completely liberal tendencies in which marriage is perceived as gender-neutral and the divorce is no longer pathologized, but considered a legitimate solution to the crisis of cohabitation. The question is whether it is de lege ferenda necessary to insist on the current legislation on marriage and its divorce, which can be described with a bit of exaggeration in the words 'an impregnable fortress'. The essence is that the one who is not allowed to do so is enrolled in the marriage… And the one who is bound by marital obligations in a formal status relationship wants to quickly and without "unnecessary paperwork and double participation in court proceedings" out. |
