Description Recently, the question of a winning bid price in public procurement has been frequently discussed. A winning bid price is sometimes higher than the usual market price. Even a bid with an unusually high price can win for various reasons. General public tends to suspect that this is due to various anticompetitive practices such as, for example, cartel agreements. As a matter of fact, the Czech Competition Authority finds an excessive bid price to be one of the main indications for launching antitrust inquiries. On the other hand, a high bid price may be attributable to fully legitimate reasons such as the need to allocate a large part of manufacturing capacity to the fulfilment of a public contract or the necessity to modify “serial” products. What are all the reasons behind a high price? Does a high bid price automatically entail that the bid is not economically advantageous for the contracting entity?
