| Description | The prosecution of vehicle operators for selected offences committed by unnamed or unknown drivers has been a controversial topic since the beginning of its legislative anchoring, not only in connection with frequent questioning of its constitutional conformity. Problems also arise in the application practice regarding the fulfilment of individual conditions which are set by the law in order to apply the (secondary) strict liability of the vehicle operator. |
