| Description | The paper focuses on selected issues (mainly procedural) concerning the functioning of derivative actions in Czech law. Derivative lawsuits are already an established institution in the Czech legal environment, on which the case law of the Supreme Court has repeatedly commented. Nevertheless, there are a number of problematic or contentious issues related, in particular, to the representation of a business corporation in court proceedings initiated by a derivative action, on which the NS has not yet commented. At the same time, these questions have, with some exceptions, been somewhat outside the interest of the discussion of the professional public. |
