Description Clean air, safe water, healthy soil and biodiversity are among the many objectives of the European Union's green policy. However, humanity has not yet reached a stage of development where an environmentally friendly economy would be at least about as expensive as an economy with a negative impact on the environment. Assuming that people are economically rational beings, the above seems to be a fundamental obstacle of achieving the desired goals of EU green policy. The first way to achieve these goals seems to be to directly or indirectly force polluters to use such technologies in volumes in which there will be a real positive impact on the environment, despite the negative economic impacts. However, such a solution is economically inefficient and creates a situation in which it will be more profitable not to respect the set rules. The second and more rational way to achieve these goals is through investment in research and development. Through research and development, more powerful technologies can be achieved, or less costly to achieve the same efficiency. R&D therefore seems to be a good way to approach the desired situation, an economically equally costly economy without negative environmental impacts compared to an economy that has a negative environmental impact, without the need for excessive state intervention. Although it can be assumed that the above-mentioned desirable situation will never be met by humanity, it can also be assumed that the addressees of legal norms regulating pollution will respond more positively to further restrictions in favor of the environment if there are more economically available alternatives to pollution processes. This paper will therefore focus on the theoretical background to the role of R&D in environmental protection and the related need of support by Member States or the European Union to invest in R&D support.
