| Description | The book deals with the issue of abortion, focussing on its human rights aspects and its relation to the freedom to provide services within the European Union. In other words, two dimensions of abortion are explored. The first dimension is related to the still contested concept of abortion as a human right, including the nature and extent of its institutional protection. The second dimension is of a different nature, as it considers abortion not as a human right but as a health service in the sense of EU primary law, in relation to one of the fundamental freedoms of movement. From a methodological point of view, the study not only analyses the international legal framework for abortion and the related case law of the ECtHR and the CJEU, but also compares national abortion legislation. In this context, the phenomenon of abortion tourism, which is difficult to prevent due to the guarantee of the free movement of services within the European Union, is also considered. |
