Citation
Description When professor of legal philosophy Vladimír Kubeš was not allowed to publish any of his works in Czechoslovakia, he directed his scientific and pedagogical activities abroad. For 10 semesters he taught at the Faculty of Law in Vienna. When his time as a visiting professor ended in June 1981, he was commissioned by Bruno Kreisky, then Federal Chancellor, to write a book on the relationship between Hans Kelsen and František Weyr for the Hans Kelsen-Institut. Kubeš of course welcomed this with joy, because it was a subject very close to his heart, and he really respected and even loved Weyr as his teacher; it also enabled him to continue to visit Vienna. After a year's work, Kubeš presented a work entitled Hans Kelsens und Franz Weyrs Leben und Werk (Einige Skizzen), in which he compares Weyr's teachings with those of Kelsen, explains the essential differences between the two concepts and, above all, shows the personal aspects of both thinkers. The comparison was definitely in favour of the personality of František Weyr, the founder of the Czechoslovak branch of pure legal doctrine (normative theory). However, due to lack of funds, this book was not published and thus remained only in manuscript. Now the broadest professional public has the opportunity to get acquainted with this work of Kubeš more than 40 years after its creation.
