| Description | The article is a response to the fundamental inadequacy and desperate quality of the criticism of the proposed material plan of the Civil Procedure Code, and it deals with the contentiousness of contentious proceedings and their definition (the definition of contentious proceeding), the non-contentiousness of non-contentious proceedings and their definition (or rather the impossibility of their definition) and the distinction between contentious and non-contentious legal matters as a basis for determining in which regime a particular case should be heard and decided. |
