Description | I presented the case study of two main decisions of the Czech courts focused on sexist advertising. I analysed the dialogue between regional court and Supreme administrative court and their argumentation based on dignity and equality on the one hand and the argument of obscenity on the other. I discussed which of mentioned values is appropriate to limit freedom of expression in democratic society. I included feminist critic of the decision of Supreme administrative court in the light of the theory of Catherine MacKinnon who criticized obscenity law and reasoned the equality should be used as conflicting value. Additionally, I will explain why sexist advertising is in breach of equality principle and the limits of liberal theory of freedom of expression in context of gender (in)equality. |
