| Description | The article deals with the procedural community of the debtor and his or her spouse in execution. The article introduces the concept of procedural community and the different types of procedural community distinguished by the current Czech legal regulation. The article deals with the procedural community in execution taking into account the specifics of execution as a type of civil proceedings and the special principles that apply in execution. The following section deals with the nature of the procedural community of the debtor and the debtor’s spouse in execution. The aim of the article is to characterize the procedural community in the context of a situation where the debtor and his or her spouse act together as parties in execution and there si no claim againts the debtor'spouse. |
