| Description | The Act on Preventive Restructuring, which came into force in September 2023, introduces a completely new set of rules for rescuing viable companies. While many aspects of preventive restructuring have already been sufficiently discussed in professional circles, little attention has been paid to the procedural context. The present monograph is therefore one of the first opportunities to explore this topic not only in the context of national legislation, but also in a broader context. In addition to a critical analysis of the procedural regulation of preventive restructuring and the most important procedural institutions, it therefore also presents selected foreign regulations and analyses the purpose and requirements of the Preventive Restructuring Directive. It can be assumed that the success of preventive restructuring in the future will also depend on the functionality of the procedural rules. The procedural aspects of preventive restructuring are therefore an issue that undoubtedly deserves attention. |
