Description | On February 2007 International Court of Justice (ICJ) rendered judgment dealing with Serbian-Bosnian dispute on application of Connvention on the Prevention and Punishment of the Crime of Genocide (1948). In the furthermost case in the history of international justice ICJ enunciated that the commitment of genocide completed the objective element of crime, but in despite of certain expectation ICJ at the same time stated that forementioned act can not be attributed to Serbia, because it was perpetrated outside of its territory by non-state entities for whose conduct Serbia does not hold the responsibility. Presented paper deals with the question of subjective element of international wrongful act and describes two different approaches to the so called attributability test as elaborated by international judicial bodies. |
