Description This article points out the issue of functional connection between material law and procedural law in respect to consumer protection in contemporary private law. In spite of the fact that material law provides sufficient protection to consumers, especially due to implementation of EC directives, the procedural law does not protect consumers' rights and entitlements properly. Hence it follows that the consumer usually gives up on getting their rights protected by a court. This is happening due to expensiveness and slowness of judicial proceedings. An initiation of so called class action, as a new suggested concept of procedural law, might be the answer to this issue.
