| Description | Presented paper deals with the institute of superior respnsibility as it flows from decisions of ad hoc international criminal tribunals. Superior responsibility is compared with traditional scheme of state responsibility for international wrongful acts. According to author, in situation where superior responsibility is established in relation to the senior state officials, there is no bar to make conclusion about state responsibility for dereliction of preventive and repressive duty. State responsibility and individual responsibility are therefore closely interlinked. |
