Description | This contribution is concerned with the national and european aspects of administrative alien detentions. In the introduciton, it delimits the concept of administrative detention and offers a concise overview of the constitutional and international legal fundaments for the administrative detention. The contribution further analyses some examples of alien detentions in the Czech legal order. These detentions are however dealt with not only from the national perspective but (predominantly) from the european perspective. The contribution thus examines the impact of the European Convention on Human Rights and the jurisprudence of European Court of Human Rights on the national regulation. It largely focuses on the weak spots in the Czech regulation. Furthermore, the contribution surveys the current state of alien detention regulation in the law of European Union (mainly in the context of the Common European Asylum System) which is however still in the very beginning. |
