Description | The New York Convention deals with the party autonomy at three places. First, it recognizes the right of parties to choose the law governing the arbitration agreement. Secondly, it enables the parties to regulate the composition of arbitral tribunal and the arbitration proceedings. And last but not least it counts on possibility that the parties have the right to choose the law governing arbitration. The Convention does not regulate directly the party autonomy in international commercial arbitration. Its importance rests in the fact that it respects the party autonomy in international commercial arbitration which has contributed to the wide recognition of the principle of party autonomy in modern international commercial arbitration. |
