| Description | Presented paper elaborates the issue of superior responsibility in international criminal with special focus on its municipal implementation and eventual application. Superior or commander responsibility forms integral part of international criminal law, whose customary nature is currently widely recognized. Author analyzes the structure of superior responsibility, its relation to other forms of responsibility in international criminal law and draws an inference, that application of domestic regulations is currently precluded by the prohibition of retroactivity which is potentially circumvented by usage of general institutes forming integral part of domestic penal law. |
