Description | This contribution deals with issues of application of European law by the Constitutional Court of the Czech Republic. The article starts by outlining the position of the Constitutional Court in the Czech constitutional system which, to a certain extent, foreshadows the problems. connected with the application of European law.1 This outline will be supplemented with a consideration of whether and how this position was affected by the entry of the Czech Republic into the European Union. The discussion will then proceed with selected problems faced by the Constitutional Court: mainly the review of legal regulations implementing European law and the possible interaction between the Constitutional Court and the European Court of Justice by means of the preliminary issue under Article 234 of the Treaty establishing the European Community. |
