| Description | The article deals with the problematic of the first part of special part of Criminal Code, act n. 40/2009 Collection, which concerned the crimes against life. It focuses especially on the murder and its relation to the slaughter and murder of the baby by his mother. There are mentioned the possibilities of the court to use mitigating circumstances and aggravating circumstances and the moderation right of the court.
