Description The Article 176 of the Treaty Establishing the Eurooean Community enables Member States to accept or to preserve stricter measures to protect the environment than those set by the EC law. On the other hand, the treaty contains the Article 95 according to which Member States can introduce national provisions based on new scientific evidence relating to the protection of the environment or the working environment on grounds of a problem specific to that Member State arising after the adoption of the harmonisation measure, if they deem it necessary. The aim of the contribution is to explore the relation between those articles and to explain what stricter measures represent.
