Description | Recently, new Act on systems of payment (Czech Act n. 284/2009 Coll.) has been brought to effect, as well as the Act that changes certain acts in connection with the Act on systems of payment coming into force. The Act on systems of payment fixes among others the payment services contract. Nevertheless, the payment services contract is not new kind of contract. This regulation describes under what circumstances is certain contract considered to be payment systems contract and under what circumstances it is considered not to be payment system contract. This is valid for existing kinds of contracts, eventually for unnamed kinds of contracts. In our case this refers to the current account contract and the deposit account contract. From now one, we have to contradistinguish the account contracts, which are considered to be the payments system contracts, and the contracts, which are not considered to be the payment systems contracts. If the account contracts are considered to be the payments systems contracts, we do not apply to them certain provision of their legal regulation in the Commercial code. Such questions are the topic of this article. |
