| Description | A new Payment System Act has been passed recently and simultaneously a new act, which changes certain acts in connection with release of Payment System Act, has been published. The Payment System Act modifies (among others) a financial services contract. However it is not a new contract type. This regularization sets among others the terms when a contract is considered to be a financial services contract or it is not. This holds for present contract types, eventually even for innominate contracts. In our discussed case it pertains to a current account contract and to a contract of deposit account. From now on we will have to distinguish contracts on accounts, which are financial services contracts, and contracts on accounts, which are not considered to be financial services contracts. If contracts on accounts will be financial services contracts then some regulations from their legislation in the Commercial Code will be not used. Today's article deals with these questions. |
