| Description | In the Czech legal system it is possible to enforce a judicial decision in two ways. Firstly it is possible in the court proceedings regulated by the sixth part of the Czech Civil Procedure Code. Secondly it is possible in the special proceedings regulated by the Czech Execution Code. In that connection it is necessary to add that the article 130 of the Czech Execution Code states that if the text of the act deals with term "enforcement of the decision", it is necessary to use this act also for the execution. This article deals with the potential abuse of rights of the executor. |
