Description | This paper offers a couple of comments on the Court of Justice Alassini judgment. This judgment sets forth the requirements put on mandatory alternative dispute resolutions (ADRs) in Member States. These are non-binding nature of the outcome of a dispute resolution; stay of limitation periods; no or trifling costs of ADRs; should ADR be in an online form, it must be also available offline to those who do not have access to the Internet; provisional measures by the courts are possible, there being an urgent need during the ODR proceedings. The Alassini judgment further elaborates on the principle of effective judicial protection in relation to the mandatory out-of-court-dispute resolutions and the legal effects of Commissions Recommendations on the latter. |
