Description | Article deals with problem of (actual or alleged) religious arguments in judicial opinions, especially in relation to Czech case-law. Initially, the general principles of religious neutrality are mentioned together with examples of normative references to religious norms in Czech law. Main part of the article focuses on relevance and permisibillity of extra-legal arguments in judicial reasoning, especially religious references (biblical quotations). Theoretical conclusions are confronted with selected decisions of Czech courts. |
