Description | This contribution deals with the possibility of recognition and enforcement of annulled arbitral award in the frame of the New York Convention. Even though Article V/1e of the Convention states, that recognition and enforcement of arbitral award may be refused, if the award was annulled in the state where it was rendered, the Convention does not preclude the recognition of annulled award. The key element is the Article VII of the Convention which enables to use the more favourable national regulation. The text of the Article VII is supported by the textual, systematical and teleological interpretation of the Convention. |
