Description This paper analyses the legal regulation of Falcidian portion, stating that if the decedent’s estate is overburdened with legacies, the heir can retain at least one quarter of the estate. This rule and similar ones in ancient Rome are compared with those contained in civil codes in the territory of the Czech republic (Austrian Civil Code 1811, not realized Draft of Civil Code 1937, Civil Code 1950, Civil Code 1946 that is still in force, present Draft of Civil Code that is likely to be enacted soon).
