| Description | A new provision of § 25.6 was introduced in the 2008 amendment of the Act No. 246/1992 Coll. on the protection of animals against cruelty. It is dealing with the duties of authorized persons in cases requiring sealing of the apartment to insure that there will be no animal left in it without the access to water and food. In practice, the problems occurred related to the compensation of the costs incurred for the care about the animal. It resulted in the reluctance of the state to pay the compensation to municipalities that are obligated to ensure the care about the animal in these cases. The contribution is focused on the analysis of different situations with the aim to find a person responsible for bearing the costs in each case. |
