Founding an association
What's an association?
The association is a voluntary and self-governing group of persons guided by a common interest. According to the Civil Code, an association is a corporation - a special type of legal entity, the legal regulation of which is found in §214-302 of Act No. 89/2012 Coll.
Advantages and disadvantages of an association
The advantage of an association is its status as a legal subject, which facilitates its position for negotiations with other legal entities, authorities and other bodies (e.g. city, regional authorities, etc.).
The disadvantage is the need to go through administrative and legal processes related to the establishment and existence of an association and to fulfil the obligations imposed on associations in the administrative or economic field by specific laws (e.g. to publish prescribed documents in the register of associations, to keep accounts, etc.). The statutory body of the association, not Masaryk University, is responsible for the proper performance of these obligations.

Founding of an association
- At least 3 persons (MU students) - founders – are needed to establish an association. In order to establish an association, it is necessary to draw up a draft statute, which contains at least:
a) The name and registered office of the association (must include the words "association" or "registered association" or the (Czech) abbreviation "z. s.")
b) the purpose of the association,
c) the rights and obligations of the members towards the association,
d) the designation of the statutory body. - The founders hold a constituent meeting at which they approve the statutes of the association and elect the members of the statutory body, or discuss other matters provided for by law. Minutes of the meeting shall be taken
Formation of the association
- The association is formed by registration in the public register, which is carried out by the court. The statutory representative of the association fills in the electronic form of the Ministry of Justice and submits it, including the mandatory annexes, to the registry court: Regional Court in Brno, Husova 353/15, 601 95 Brno / podatelna@ksoud.brn.justice.cz.
Required attachments:
a) the statutes of the association,
b) an affidavit by a member of the statutory body that he or she is eligible to be a member of the statutory body under the Civil Code,
c) the minutes of the constituent meeting containing the decision on the appointment of the member(s) of the statutory body and the approval of the statutes,
d) a document certifying the legal reason for the use of the premises where the registered office of the association is located; in the case of a declaration by the owner of the property, it must not be more than 3 months old and the signature must be officially certified.
2. Reporting the formation of the association
After completing the administrative and legal processes associated with the establishment and formation of the association, it is desirable to report the existence of the new association to the Platform of Student Associations of Masaryk University, which registers all associations and clubs at the university. To report the formation of a society, please use the form below exclusively. On the basis of the submitted data, the coordinator of the society’s activities will create a profile of the new society on this website, the editing of which will be subsequently in the hands of authorized persons.
3. Conclusion of cooperation with the university
It is advantageous for associations to enter into mutually beneficial cooperation with the university. The conclusion of the Framework Cooperation Agreement entitles the association to use the common premises allocated by the university for the association's activities in the building at Komenského náměstí 2. With the concluded agreement, the association also has the possibility of renting presentation systems for the promotional purposes of its activities. The obligations of Masaryk University include marketing support and the possibility of financial and material support for the activities of the association.

Establishment of a club
What's a club?
A club is a community of members of an academic community (usually students) operating on an informal level to nurture and develop the common interests of its members.
Advantages and disadvantages of the club
The club does not have to go through any complicated legal procedures and has no obligations towards the authorities. The club has the advantage of a high degree of functional flexibility.
On the other hand, however, this form carries certain disadvantages, e.g. a worse position when dealing with authorities or when applying for financial support (the club representative legally acts for himself/herself as a natural person/individual). The name of the club must not contain the word 'association'.
How to start a club
1. Establishment of a club
Nothing more than, for example, a verbal agreement is required to establish and operate a club.
2. Announcement of the formation of the club
It is advisable to report the existence of a new club to the Platform of Student Societies of Masaryk University, which registers all societies and clubs at the University. To report a club, please use the form below only. On the basis of the submitted data, the coordinator of club activities will create a profile of the new club on this website, which will be edited by authorized persons.
3. Conclusion of cooperation with the university
It is beneficial for the club to enter into a mutually beneficial cooperation with the university. The conclusion of a Memorandum of Cooperation entitles the club to use the common premises allocated by the University for its social activities in the building on Komenského náměstí 2. With the concluded agreement, the club also has the possibility to rent presentation systems for the promotional purposes of its activities. The obligations of Masaryk University include marketing support and the possibility of financial and material support for the club's activities.
