Description | This article provides commentary on the anticipated amendments of the Czech construction legislation which aims to introduce a new fee (guarantee) for appeal and a “penalty” court fee for misuse of the law. In particular, it analyses the corresponding case law of the European Court of Human Rights concerning protection under Art.1 of the European Convention on Human Rights and the case law of the Court of Justice of the European Union concerning public participation in environmental matters. The author concludes that the fee (bail) for appeal goes way beyond the limits established by the CJEU in its judgements in C-216/05 (Commission v Ireland) and C-530/11 (Commission v United Kingdom) because it is selective and overly restrictive. The court fee for misuse of the law, on the other hand, may meet the criteria of wide access to justice as it is conceived to target the extreme cases of insulting actions. |
