Description | Th is article provides a brief critique of the recent judgement of the Czech Constitutional Court of 18 December 2018, No. II. ÚS 1685/17, in which the Court granted a broad interpretation of general rules on public participation in decision-making in Art. 70 of Act. 114/1992 Coll. on Nature and Landscape Protection. Based on Art. 9(3) of the Aarhus Convention and the obligation of consistent interpretation with the EU law, the Court supported the participation of the environmental NGOs in administrative criminal proceedings. However, such a signifi cant step seems unsystematic, since otherwise the criminal enforcement remains entirely in the hands of the offi cial authorities and the members of the public concerned may separately question the legality of the harmful activity in court. Moreover, neither the Aarhus Convention nor any specifi c stipulations of the EU directives appear to be applicable in this case. |
