Description This article provides a brief commentary on the recent judgement of the Supreme Administrative Court of the Czech Republic (judgement of 16 May 2019, no. 10 As 228/2018-23) according to which the owner of the cultural monument cannot in principle ask for judicial review of the governmental decree which declares his property a national cultural monument. The authors dispute the conclusion of the Court that the declaration does not affect the rights of the owner and illustrate the practical effects of the stricter protective regime. Furthermore, the article analyses the legal regulation in other European states which usually provides the owners with legal protection against the declaration of the cultural monuments. The authors conclude that the Czech legislation should be either interpreted extensively in order not to deprive the owners of legal protection, or changed.
